Agreement Notice: By using TopLine Academy's services, you agree to be bound by these Terms and Conditions. Please read them carefully before booking or attending tutoring sessions.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student", "Parent", "Guardian", or "Client") and TopLine Academy ("we", "us", "our", or "Academy") regarding your use of our tutoring services.

By booking, attending, or paying for our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Provided

2.1 Educational Services

TopLine Academy provides tutoring services for students in Grades 8-12, specializing in:

  • Mathematics
  • Physical Sciences
  • Life Sciences
  • Accounting
  • Other subjects as available

2.2 Service Delivery

Services may be delivered through:

  • In-person tutoring at our Meadowlands location
  • Group tutoring sessions
  • One-on-one tutoring sessions
  • Online tutoring (when available)

2.3 Service Limitations

We reserve the right to:

  • Modify service offerings and schedules
  • Refuse service to any individual at our discretion
  • Substitute tutors when necessary
  • Adjust class sizes based on demand

3. Booking and Registration

3.1 Booking Process

  • All bookings must be made through our official website, phone, or in person
  • Bookings are subject to availability
  • You will receive a booking confirmation via email
  • Booking references must be retained for your records

3.2 Student Information

You must provide accurate and complete information including:

  • Student's full name and grade
  • Parent/guardian contact details
  • Medical conditions or learning requirements (if applicable)
  • Emergency contact information

3.3 Age Requirements

  • Services are for students in Grades 8-12
  • Students under 18 require parental/guardian consent
  • Parents/guardians are responsible for students under 18

4. Payment Terms

4.1 Fees and Pricing

  • All fees are quoted in South African Rand (ZAR)
  • Prices are subject to change with 30 days' notice
  • Current pricing is available on our website or upon request
  • Special discounts or promotions may be offered at our discretion

4.2 Payment Methods

We accept payment via:

  • Cash
  • Bank transfer (EFT)
  • Credit/debit cards (when available)
  • Mobile payments (when available)

4.3 Payment Requirements

  • Payment must be made in advance of each session or as per the agreed payment schedule
  • No student will be admitted to a session without confirmed payment
  • Late payments may result in suspension of services
  • Outstanding balances may be subject to collection procedures

4.4 Receipts and Invoices

  • Receipts are provided for all payments
  • Tax invoices available upon request
  • Keep receipts for your records

5. Cancellation and Refund Policy

5.1 Cancellation by Client

  • More than 24 hours before session: Full refund or credit for future session
  • Less than 24 hours before session: 50% refund or credit
  • No-show or same-day cancellation: No refund
  • Emergency situations: Considered on a case-by-case basis

5.2 Cancellation by Academy

If we cancel a session:

  • You will receive full refund or free rescheduling
  • We will notify you as soon as possible
  • Alternative session times will be offered when available

5.3 Refund Processing

  • Refunds processed within 14 business days
  • Refunds issued via original payment method
  • Processing fees may apply to credit card refunds

6. Attendance and Conduct

6.1 Punctuality

  • Students must arrive on time for scheduled sessions
  • Late arrivals (more than 15 minutes) may forfeit the session
  • Sessions end at the scheduled time regardless of late arrival

6.2 Student Conduct

Students are expected to:

  • Behave respectfully toward tutors and other students
  • Come prepared with necessary materials
  • Participate actively in sessions
  • Follow Academy rules and policies
  • Respect Academy property and equipment

6.3 Disciplinary Action

We reserve the right to:

  • Issue warnings for misconduct
  • Suspend students for repeated violations
  • Terminate services without refund for serious misconduct
  • Report criminal behavior to authorities

6.4 Parent/Guardian Responsibilities

  • Ensure student attends scheduled sessions
  • Drop off and pick up students on time
  • Inform us of any medical or learning needs
  • Support student's learning at home

7. Intellectual Property

7.1 Academy Materials

  • All teaching materials, worksheets, and content are our intellectual property
  • Materials are for personal educational use only
  • Reproduction, distribution, or commercial use is prohibited
  • Copyright infringement will be prosecuted

7.2 Student Work

  • Students retain rights to their original work
  • We may use anonymized student work for promotional purposes with consent
  • Progress reports and assessments remain confidential

8. Privacy and Data Protection

Your personal information is protected in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

8.1 Information Use

  • We collect and use information only for tutoring services
  • Information is kept confidential and secure
  • We do not sell or share information with third parties

8.2 Marketing Communications

  • We may send educational updates and promotional materials with consent
  • You can opt-out of marketing communications at any time
  • Service-related communications (e.g., session reminders) will continue

9. Liability and Disclaimers

9.1 Educational Results

  • We do not guarantee specific academic results or improvements
  • Student progress depends on multiple factors including effort, attendance, and aptitude
  • We provide quality tutoring but cannot control external factors

9.2 Liability Limitations

To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, or incidental damages
  • Our total liability is limited to the amount paid for services
  • We are not responsible for student injuries unless due to our negligence
  • Parents/guardians are responsible for student safety outside of sessions

9.3 Force Majeure

We are not liable for failure to perform due to circumstances beyond our control, including:

  • Natural disasters
  • Government actions or restrictions
  • Pandemics or health emergencies
  • Power outages or technical failures
  • Labor strikes or disputes

10. Health and Safety

10.1 Medical Conditions

  • Inform us of any medical conditions, allergies, or special needs
  • Provide emergency contact information
  • Students with contagious illnesses must not attend sessions

10.2 Safety Measures

  • We maintain a safe learning environment
  • First aid facilities are available
  • Emergency procedures are in place
  • COVID-19 protocols followed as per government guidelines

10.3 Insurance

  • We maintain appropriate business insurance
  • Parents/guardians should maintain personal insurance for students
  • We are not responsible for personal belongings

11. Termination of Services

11.1 By Client

  • You may terminate services at any time with written notice
  • Refunds for unused prepaid sessions subject to cancellation policy
  • Outstanding balances must be settled

11.2 By Academy

We may terminate services for:

  • Non-payment of fees
  • Repeated misconduct or policy violations
  • Providing false information
  • Threatening or abusive behavior

12. Dispute Resolution

12.1 Complaints Procedure

  1. Submit written complaint to management
  2. We will investigate and respond within 14 days
  3. If unresolved, escalate to senior management
  4. Final resolution attempted within 30 days

12.2 Governing Law

  • These Terms are governed by South African law
  • Disputes subject to jurisdiction of South African courts
  • Mediation preferred before litigation

13. Changes to Terms

  • We may modify these Terms at any time
  • Changes effective upon posting to website
  • Significant changes will be communicated via email
  • Continued use of services indicates acceptance of changes
  • Review Terms regularly for updates

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and TopLine Academy regarding tutoring services.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Acknowledgment: By using TopLine Academy's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
